Open Payments and State Reporting Requirements

With the enactment of the US Physician Payments Sunshine Act in 2013, drug and medical device manufacturers are required to annually report payments and transfers of value to, or on behalf of, healthcare professionals (HCPs, such as physicians, physician assistants, and nurse practitioners) and healthcare organizations (HCOs, such as teaching hospitals) to the Centers for Medicare and Medicaid Services (CMS), which in turn makes the information publicly available.

Many states also have their own reporting requirements, which vary from state to state. The consequences of incomplete or inaccurate reporting on either a federal or state level can be significant, potentially resulting in millions of dollars in fines. As such, manufacturers need to maintain careful compliance on an ongoing basis, and they should begin at least six months prior to launch.
